Capital punishment, the penalty of death for the commission of a crime, is a controversial issue on which individual nations take many differing stances. This article categorizes individual sovereign entities within NationStates by their respective policies on the death penalty.

International law
The United Nations (2002-08) attempted to standardize death penalty laws within UN member states with only a few resolutions. The resolutions that have attempted to ban capital punish and adopt an abolitionist stance have been defeated. The Fair Sentencing Act reserved the right of UN members to set their own sentencing standards, and supported neither the pro- or anti- death penalty position. Right to Refuse Extradition allowed nations to refuse to extradite any criminal they believed would be subject to the death penalty in the nation requesting extradition. These resolutions are no longer in effect.
Since the UN's disbandment in 2008, the succeeding World Assembly has specific laws regarding the death penalty under the Convention on Execution. Other provisions include a fair-trial resolution that effectively forbids summary executions.
